Mustard Sandwich shall hereinafter be referred to as the "agent." The original adopting party, and solely the original adopting party, shall hereinafter be referred to as the "owner." ____________________________________________________________________________________________________________ Terms and Conditions ____________________________________________________________________________________________________________ 1. The Owner must have the puppy examined by a licensed veterinarian within fourteen (14) days of receipt of the puppy excluding Sunday and holidays. The Agent must be informed within five ( 5) days of the examination resulting in life threating conditions. Failure to comply will render this guarantee void. Mustard Sandwich, the agent must be notified by telephone at 910 238 9936 and by email at adopt@mustardsandwich.net 2. The Owner is responsible for the daily health care and maintenance of the pet, including all immunizations and examinations recommended after the adoption, as well as providing necessary medication and follow-up treatments from veterinarian visits. In order for the guarantee to remain in effect you must keep receipts and records to verify that you have regularly taken your pet to a duly licensed veterinarian for checkups and all required immunizations. All immunization records must indicate that inoculations were administered on time. 3. In the unlikely event of the death of the puppy within one (1) year from its birth due to genetics or viral disease excluding Lyme tick disease the Agent shall replace the pet with another of at no cost to the Owner within ninety (90)days. All conditions set forth in paragraph 14 shall apply. 4. In the event of the death of the puppy, due to genetics, after the first year of birth, the Agent shall issue a credit in the amount of 60% of the original adoption fee and towards the cost of a replacement puppy to the Owner valid for 90 days. The conditions set forth in paragraph 14 shall apply. 5. If the Owner declines the replacement puppy, then the Agent shall be under no further obligation and it will be deemed that the Buyer has released the Agent from all further claims. The Agent will not be responsible for finding a duplicate puppy , the buyer will have ninety days (90) to choose a puppy that is available through Mustard Sandwich. 6. In case of severe knee, elbow or hip dysplasia, the radiograph should be permanently identified in the film emulsion with: name and/or number, name of the veterinarian or hospital making the film, date of radiograph taken. Furthermore, the radiograph and report must meet OFA's standard submission requirements. 7. The value of the puppy for the purpose of this guarantee is solely the original adoption fee of the puppy, this does not include shipping expenses or any other associated costs. 8. This guarantee is non-transferable, and will be null and void should the puppy be transferred to another party. 9. All puppies are sold as pets; no guarantee is made as to disposition, conformation, size, weight, color, markings or breeding ability. 10. Mustard Sandwich will deliver the puppy to you with a current medical record and a Veterinarian Certification stating the health of the puppy. Any pre-existing medical conditions noted on the top of this agreement and the Veterinarian Certificate shall not be covered in this guarantee. 11. In the event of any litigation in connection with this contract, the Agent will be paid reasonable attorney fees by the Owner. Venue and jurisdiction for litigation arising out of or related to this contract shall lie exclusively in Onslow County, NC. 12.Transportation of the puppy is arranged through Mustard Sandwich. Occasionally there may be delays for numerous reasons including, but not limited to, weather, temperature restrictions, logistics, mechanical failure, or other unforeseen events. The Agent shall not be liable directly or indirectly for any delays that may cause the Owner inconvenience or financial loss. 13.The agent will not accept any returns of said puppy for any monetary refund, including but not limited to allergy, Landlord/Tenant, marital, or adjustment problems, etc. If Owner must return puppy for any reason, it will be on a surrender basis only with no refund or life time guarantee credit. _____________________________________________________________________________________________________________ Limitations of Lifetime Guarantee: _____________________________________________________________________________________________________________ 14. The Agent defines "Lifetime" referred herein as a period of ten (10) years from the puppy's date of birth. This 10 year period is covered by Mustard Sandwich The dog must be maintained in good physical condition with proper nutrition. In the unlikely event said puppy is found to have a congenital , genetic defect or virus not including lyme tick disease that will terminate the life , a statement from 2 different licensed DVM's (Doctor of Veterinary Medicine) of Owner's choosing confirming such an event and cause is required before any action will be taken by the Agent or Owner. Agent reserves the right to a third opinion of Agent’s choosing to determine the defect. All shipping costs are paid by the Owner. No replacement will be given if the female has been bred. All laboratory verification must be done by a licensed Veterinarian. No replacement will be given if hip dysplasia is caused by over weight or improper exercise. Failure of the Owner to provide puppy with timely inoculations or regular veterinary care will void this guarantee. This guarantee does not cover any Veterinarian costs. The Owner is aware that owning a puppy means timely visits to a Licensed Veterinarian and understands that he/she will be responsible for all payments. This guarantee does not cover any of the following conditions: intestinal parasites (ie Coccidiosis, Giardia, Tapeworms, Hookworms, Roundworms) Kennel Cough, Lyme Tick Disease Skin and Ear Mites, Cherry Eye, Allergies, and Inguinal, Perineal, or Diaphragmatic Herniation, Heart Murmur grades I, II or III, Patella Luxation grades I, II or III. This guarantee does not cover any Veterinarian costs associated with spaying or neutering, including undescended testes. All the above mentioned conditions must be met or all guarantees above mentioned will be void. Temperament issues are not covered under this guarantee as they can be caused by a lack of training, discipline or proper dog socialization. The owner is responsible for all transportation costs. If within one (1) year from the date of adoption from Mustard Sandwich, a dog is found and certified by two (2) duly licensed Veterinarian doctors to have congenital , hereditary disorders or virus which adversely affect the life of the animal, and if Agent is notified within five (5) business days of the Veterinarian's determination, the agent will provide a replacement puppy. Mustard Sandwich is not responsible for any veterinarian fees, shipping costs or any other a associated costs. Agent places pets for companion purposes only. Agent does not guarantee against low-blood sugar (Hypoglycemia), or any other non-life threatening illnesses common to puppies. I hereby acknowledge that I have received a copy of this document as well as described herein pertaining to my pet's health inspection signed by veterinarian. Further, I accept the terms and conditions of the guarantee for congenital, hereditary or viral disorders (see paragraph 14), printed in this document, and I waive and relinquish any other rights that I might otherwise have in the event of such occurrence. This agreement represents the total agreement between Mustard Sandwich and the buyer and no other terms or conditions shall be valid to this sale. The purchaser acknowledges that he or she has read, understands and agrees to the terms of this document. No cash or credit card refunds for this guarantee, neither is it transferable.
